Thank you for taking the time to read our privacy policy. At ICON International, Inc. (“ICON”, “We”, “Us”, or “Our”), your privacy is of the utmost importance. We want you to be fully informed about the information we collect, how it is used, shared, and protected, and the choices you have with it and explain the privacy and data practices at ICON.

This privacy policy sets out how we collect, use, process, store, share and disclose your Personal Information when providing ICON’s advertising services (the “Services”).

This Privacy Policy does not apply to the ICON website located at www.iconinternational.com nor does this Privacy Policy apply to the ICON Company Store located at https://iconcompanystore.com.   1. PERSONAL INFORMATION ASSOCIATED WITH ICON PRODUCTS & SERVICES

End Consumer personal information:

When our business customers (“Customers”) use our Services, they may enable ICON to process various types of personal information about their end customers (“End Consumers”). Below, we provide a list of the commonly processed End Consumer personal information provided by our Customers. Please note, the below list is not exhaustive of all personal information, and is intended to serve as a sample set.

  • Information about your computer hardware and software including: IP address, browser type, domain names, access times, operating system, referring website addresses, browsing history, viewing history, search history, and device type. We may also infer your imprecise location from your IP address.
  • Cookies and other Tracking Technologies. We may use cookies, beacons, pixel tags, and other similar technologies to collect additional information automatically as you interact with the Services and to personalize your experience with our Services. Learn more about our cookie use below.
  • Personal identifiers including device Identifiers such as mobile advertising IDs like IDFA or AAID, and hashed email addresses.
  • Inferences or derived audience segmentation, including information about your internet browsing history. 
  • Information about ads served, viewed or clicked on, including the type of ad, where the ad was served, whether you clicked on it and whether you visited the advertiser’s website or downloaded the advertiser’s app.

Customer personal information: 

In order to serve our Customers, ICON will collect various information through our software and customer support channels, including:

  • Corporate email addresses for email correspondence.
  • Customer service and other correspondence.
  • Billing and financial information.
  • Information about how our Customers use our software products and services, including time spent on our applications, behavioral activity, and metadata associated with software interactions.
  1. PERSONAL INFORMATION USES

Subject to the terms of our Customer agreements, in addition to supporting our Customers use of our Services, we may use personal information for the following purposes:

  • To provide our Services including for advertising and marketing to End Consumers.
  • Customer support, including email and chat.
  • To authenticate, verify, or otherwise ensure compliance with Customer written instructions or to mitigate the risk of fraud.
  • For any legal purpose necessary, including IP protection, or if ICON is required to process information as a result of a court order or other legal or regulatory proceeding.

We may use aggregated and anonymous information about the various types of information, integrations, metadata and performance metrics to ensure our products and services are serving their intended purposes and for product improvements.

  1. PERSONAL INFORMATION INTEGRATIONS & DISCLOSURES

Our products and services provide Customers with the ability to synchronize certain external software or data applications with ICON, which may include the transfer of personal information. Some of these integration applications may be found on our partners page. Some of the types of applications are:

  • Customer Support.
  • Customer Relationship Management.

Subject to Customer agreements, we may disclose personal information provided by or obtained by our Customers in order to:

  • Provide marketing and advertising services, including disclosing personal information to third-party marketing and advertising partners.
  • Protect the legal rights of our company, our employees, our agents, and our affiliates.
  • Protect the safety and security of those who access and use our Services.
  • Detect and protect against fraud.
  • Comply with law or legal process.
  • Complete a legal transaction related to the sale of our business or any assets.

ICON may share aggregate or anonymous information for any purpose. This means that the information we share does not identify specific individuals, or is combined with other data to protect your privacy.

  1. PRIVACY CHOICES

If you are a current or former employee of one of our Customers, or believe your are an End Consumer of one of our Customers and that your information was uploaded to ICON by one of our Customers, and you would like to fulfill your rights to the personal information we maintain about you on behalf of our Customer, please contact a representative of that Customer rather than email us with your request. We can not provide personal information about a specific individual on behalf of a Customer without their express written instructions.

You can exercise an industry-wide opt out of targeted advertising using the following links:

  • The Network Advertising Initiative opt-out at www.optout.networkadvertising.org. 
  • The Digital Advertising Alliance (DAA) opt-out at www.optout.aboutads.info. 
  • The IAB Europe’s industry opt-out at www.youronlinechoices.eu. 

In addition, you can configure your web browser (Chrome, Firefox, Internet Explorer, Safari, etc.) to delete and/or control the use of cookies.

  1. SECURITY

We maintain reasonable safeguards to protect against unauthorized access, use, modification, and disclosure of personal information in our custody and control. ICON limits access to personal information to ICON personnel and service providers who require that information to provide products or services to you or in order to do their jobs. We have physical, electronic, and procedural safeguards to protect the loss, misuse, and alteration of the information under our control. Despite our efforts, we cannot guarantee that unauthorized access or use will never occur. It is important that you take steps to keep your information safe and secure. Choose an account password that is hard for others to guess and don’t reveal it to third parties. If you use a shared public computer, do not opt to have your login ID or password remembered and be sure to log out of your account when you finish.

  1. RETENTION

We will retain End Consumer and Customer personal information according to the terms of our written agreements.

  1. U.S. STATE-SPECIFIC NOTICE

California and other U.S. states have enacted comprehensive privacy laws. If you are a resident of California, Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, or Virginia, you may have certain privacy rights detailed herein. 

Additional Privacy Rights:

In addition to the rights granted above, if you are a resident of any of the above states, you have the right to:

  • Opt out of the “sale” or “share” of your personal information for advertising purposes. We do not ‘sell’ or ‘share’ your personal information.
  • Sensitive personal information. We do not collect sensitive personal information in providing our Services.
  • Opt out of profiling. We do not profile as defined by U.S. state privacy law.

Appeal:

If we deny your privacy request, you may appeal that decision by emailing us at [email protected]. If, after your appeal has been processed by us, you are still unsatisfied with our response, you may have the right to file a complaint with your state attorney general.

Service Provider/Processor Designation:

ICON operates as a ‘Processor’ (and ‘Service Provider’ under CCPA) to our Customers.  As such, ICON does not ‘sell’ or ‘share’ any personal information of ICON Customers.

  1. UK/EEA RESIDENTS NOTICE

Residents of the (“UK”) and European Economic Area (“EEA”) are provided certain privacy rights under the UK and EU General Data Protection Regulations (“GDPR”).

Legal Basis:

Under the GDPR, we process Personal Data under the following legal basis.

Controller/Processor Designation:

Under the GDPR, we are designated as a ‘Controller’ for the collection and use of our Customers’ administrative representatives personal data to maintain their account and fulfill the Services. For all other uses of our Customers personal data, we are designated as a ‘Processor’.

Cross-Border Data Transfers:

We may transfer to, and store the data we collect about you, in countries other than the country in which the data was originally collected, including the United States, Canada or other destinations outside the EEA and the UK. Those countries may not have equivalent data protection laws as the country in which you provided the data. When we transfer your data to other countries, we will protect the data as described in this Privacy Policy and applicable supplemental product privacy policy and comply with applicable legal requirements providing adequate protection for the transfer of data to countries outside the EEA.

If you are located in the EEA, we will only transfer your Personal Data if:

  • The country to which the Personal Data will be transferred has been granted a European Commission adequacy decision; or
  • We have put in place appropriate safeguards in respect of the transfer, for example we have entered into standard contractual clauses and required additional safeguards with the recipient, or the recipient is a party to binding corporate rules approved by an EU supervisory authority.

  1. CHILDREN’S PRIVACY

We do not intentionally collect any personal information from children under the age of 13 (or 16 in California). If you are under the age of 13 (or 16 in California), please ask a parent or guardian for help in using our website or purchasing any products. If you believe we have obtained personal information associated with children under the age of 13 (or 16 in California), please contact us at [email protected] and we will delete it.

  1. CHANGES TO THIS PRIVACY NOTICE

We may update this ICON Services Privacy Notice from time to time as we update or expand our Services. If we make material changes, we will post the updated Privacy Policy on this page with a ‘Last Updated’ effective date of the revisions.
